На практике деловая среда регулярно сталкивается с ситуациями, когда в публичном пространстве появляются сведения, не соответствующие действительности. Это могут быть заказные публикации, искажённые факты, непроверенная информация или откровенно ложные утверждения, порочащие деловую репутацию. Статья 152 Гражданского кодекса Российской Федерации прямо предусматривает право граждан и юридических лиц требовать опровержения сведений, порочащих их деловую репутацию, если распространивший такие сведения не докажет, что они соответствуют действительности.
Правовые основания для удаления недостоверной информации
Работа по удалению недостоверных сведений из публичного пространства строится на чётких правовых основаниях. Это не «чёрная магия» и не «связи в редакциях» — это применение действующего законодательства.
Гражданский кодекс РФ, статья 152 устанавливает право на защиту деловой репутации. Гражданин или юридическое лицо вправе требовать по суду опровержения порочащих его деловую репутацию сведений, если распространивший такие сведения не докажет, что они соответствуют действительности. Если сведения распространены в средствах массовой информации, они должны быть опровергнуты в тех же средствах массовой информации.
Федеральный закон «Об информации, информационных технологиях и о защите информации» (149-ФЗ) регулирует порядок распространения информации и предусматривает механизмы ограничения доступа к недостоверным сведениям.
Закон РФ «О средствах массовой информации» (2124-1) устанавливает обязанность СМИ опубликовать опровержение распространённых ими сведений, не соответствующих действительности.
Федеральный закон «О персональных данных» (152-ФЗ) защищает право на удаление персональных данных, обрабатываемых с нарушением законодательства.
Это не исчерпывающий перечень — в зависимости от ситуации могут применяться и другие нормативные акты. Но суть одна: российское законодательство предоставляет достаточно инструментов для защиты деловой репутации. Вопрос в том, умеете ли вы ими пользоваться.
Что мы делаем: комплексный подход
Мы не «удаляем негатив». Мы выстраиваем правовую стратегию защиты деловой репутации, которая включает несколько направлений.
Мониторинг и анализ. Первый шаг — сбор и систематизация информации о компании или персоне в СМИ и интернете. Мы определяем, какие именно сведения не соответствуют действительности, на каких площадках они размещены, кто является их источником. Без точного диагноза лечение невозможно.
Правовая квалификация. Не каждый негативный отзыв является основанием для удаления. Мнение и оценочное суждение защищены свободой слова. А вот утверждение о факте, которое не соответствует действительности и порочит деловую репутацию, — это основание для правовой защиты. Мы проводим квалификацию каждого материала и определяем, какие правовые механизмы применимы.
Досудебное урегулирование. В большинстве случаев вопрос решается без обращения в суд. Мы направляем мотивированные обращения в редакции СМИ, администрациям интернет-площадок, хостинг-провайдерам. Обращение содержит правовое обоснование требования об удалении или опровержении недостоверных сведений. Практика показывает, что грамотно составленное досудебное обращение решает вопрос в семидесяти-восьмидесяти процентах случаев.
Взаимодействие с площадками. Мы работаем с основными интернет-площадками, где появляются публикации, затрагивающие деловую репутацию. Это включает средства массовой информации — телевидение, радио, печатные и онлайн-издания. Социальные сети и мессенджеры. Специализированные сайты отзывов. Форумы и тематические сообщества. Блоги и персональные страницы. Поисковые системы — в части удаления из кэша и индекса. Энциклопедические и справочные ресурсы.

Превентивная защита: предотвратить легче, чем лечить

Правовая подготовка. Разработка внутренних регламентов реагирования на информационные угрозы, подготовка шаблонов правовых обращений, формирование доказательной базы. Когда кризис наступает, у вас уже есть инструменты для реагирования.
Как говорил один мудрый человек: «Лучшая драка — та, которая не состоялась». С защитой деловой репутации — та же история.
Сроки и порядок работы
